the trades practices act (1974?? not sure ) is used to regulate the rights/protection for consumers and manufacturers. lol........ im v. sketchy.. done it like a few terms ago.

im not sure if im right, but i think i am.

it conveys that manufacturers should have a "duty of care" so that people who consume their products arent harmed by the actions or omissions of the manufacturer.
this case was about a women (donoghue) drinking ginger beer and she became ill, it was found that there was a snail in her drink, the retailer wasnt responsible cuz they didnt manufacturer the drink, although they should also have a duty of care because they didnt check it.. meh.

a debtor is someone who owes a creditor money/mortgage/repayments, otherwise known as a lender.

a creditor is someone who lends money.

Donoghue v Stevenson

This deals with the law of negligence.

The judge stated in order for there to be negligence, there must be:
- A duty of care owed to the plaintiff
- A breach of the duty by the defendant
- Which resulted in injury or damage to the plaintiff.

The facts are that a lady consumed ginger ale to find that there was a decomposed snail. She sued, however the issue at law was that she did not purchase the drink, how can she sue, if she is not privy to the contract? The court took negligence to a new level and allowed the claim to continue based on the three legal tests above.
