I am doing DofE Gold, and I started last year on my 16th bday (July) Because it takes 18 months to complete the program, I will not be finished until Jan '13, and after talking to the EAP people at UNSW, they said I am not eligible for the bonus points, because I will have not completed the program before the deadline for applications (14th December). Is there anything I can do about this, as it is not my fault that I am young...I have done all that I could.

Back on topic, if your aiming for 99 ATAR I assume you have the means and the work ethic to follow through with such a goal.
In achieving that 99 or thereabouts, you would have received band 6's/5's in all of your subjects which would make you eligible for HSC+ bonus points. Which would total more than 5 which is the maximum allowed bonus.
So theres no point in worrying about those 3 bonus points anyways.

I'm pretty sure it wasn't exempted back in the day.

You can get bonus points but they just won't be applicable to Law and some other programs. It's been like that for a while, at least 5 years (source).
I think HSCplus bonus points are not applicable for law, however, Elite Athletes and performers program is. http://www.unsw.edu.au/sites/default/files/documents/EAP Points 2013_5.pdf
