Hey HSC 05 guys and gals,
I just remembered a whizz bang mnemonic we learnt for contracts in the consumer option in legal (2002 HSC). I'm not sure if you folks still do contracts as part of consumers (I'm assuming you would since it's the basis of consumer law ...) But anyway, here are the elements of a legally binding contract (at least as they are taught in the HSC):
I Owe ACCC Love
(Which is so easy to remember, because we really do owe the ACCC love)
I - intention to create legal relations
O - offer
A - acceptance
C - consideration
C - consent
C - capacity to consent
L - legality of the contract's purpose
Hope it helps!
