So there's 1) CASE BRIEF
So this is background, ratio, obiter etc.. ...
So in relation to the ratio and obiter, how do we describe them
:(

HOW CRITICAL DOES THIS GO??????????????

-are we supposed to review the judges reasonings at one point

[and yes unsw law first year students, if you're out there, and you finished that damn assignment can you just contribute, i swear i won't steal your answers :)]

I imagine that a CASE BRIEF AND A CASENOTE are similar, in that you recount the facts of the case, its PROCEDURAL HISTORY, AND the decision/ratio in the final judgement!!!!!!!!!!!!!!!!!!!!!!

ON THE OTHER HAND I THINK THAT A CASE commentary would ask you to do the above, but then compare and CONTRAST THE DECISION WITH OTHER DECISIONS and examine the direction in which the LAW IS HEADED IN THE LIGHT OF THE decision in question, and any policy/practical ramiFICATIONS WHICH MAY RESULT. THIs may also allow you to provide an opinion as to whether or NOT THE DECISION IN THE CASE WAS 'CORrect,' which you would of course back up with relevant jouRNAL ARTICLES!!!!!!!!!!!
