If you use material or ideas that are not your own you have to acknowledge the source by referencing it. If you do not, that is plagiarism.

Drop it. It won't count towards your ATAR and by dropping it you wont have to worry about it and can concentrate on your other subjects. You also avoid having it appear on your HSC record of achievement.

Marking can be very subjective. My school always double marked HSC assessments so at least these kind of discrepancies were unlikely to greatly affect hsc marks.
