"Melanie has been arrested and a magistrate has determined that the case will proceed to trial. The magistrate has decided not to release her while waiting for the trial to be held.

Which of the following correctly describes Melanie's situation?

(A) She is on bail.

(B) She is in custody

(C) She is on remand

(D) She is in detention"

So the answer is technically that she is on remand in custody while awaiting trial.

What the f**k are the HSC writers thinking.

Apparently it's (C) according to the marking criteria.

Although I inquired my teacher and apparently it's (B).

If something like this happens in your HSC, get your teacher to write to the BOS.

One of my teachers has done this many times before and consequently got them to make 2 answers correct. E.g. both B and C would be accepted answers.

I feel like custody is more so in regards to being arrested. Yet remand is 'more correct' for this scenario since that is the time held prior to/during a trial and sentencing
